1. About these terms

This website is operated by PHEREIN COSMETICS ("we", "us", "our"). These Terms and Conditions apply to your use of this website and to every order you place with us. By using this website or placing an order, you agree to these terms. If you do not agree, please do not use the website or place an order.

2. Products and descriptions

We take care to describe and display our products accurately. Colours and finishes may look slightly different depending on your screen, and small variations in handmade or natural materials are normal. All products are subject to availability, and we may change or discontinue a product at any time.

3. Orders

When you place an order, you are making an offer to buy the products in your cart. A contract is formed when we confirm your order by email. We may refuse or cancel an order, for example if a product is unavailable, if there is an error in the price or description, if we cannot verify payment, or if we reasonably suspect fraud or a breach of these terms. If we cancel an order you have already paid for, we will refund the amount paid.

4. Prices and payment

Prices are shown in the currency displayed at checkout. Any applicable taxes and delivery charges are shown before you complete your order. Payment is taken through the payment methods offered at checkout. We may change prices at any time, but changes do not affect orders we have already confirmed.

5. Shipping and delivery

Delivery options, charges and estimated times are shown at checkout. Delivery times are estimates and may be affected by events outside our control. Please make sure your delivery details are correct, as we are not responsible for delays or loss caused by incorrect details. Responsibility for the products passes to you when they are delivered to the address you provided.

6. Returns and refunds

If your order arrives damaged, faulty or incorrect, please contact us as soon as possible at info@phereincosmetics.com with your order number and photos of the issue so we can put it right. Other returns are handled in line with any return policy published on this website and with applicable consumer protection law.

7. Product use and care

Please use our products only for their intended purpose and follow any care instructions provided. Clean brushes and tools regularly. If you experience irritation or discomfort while using a product, stop using it.

8. Intellectual property and prohibited copying

8.1 Ownership. All products sold by PHEREIN COSMETICS, including their designs, shapes, construction, packaging, names, logos, images and descriptions, are owned by or licensed to us and are protected by applicable trademark, industrial design, copyright and unfair competition laws. Purchasing a product gives you ownership of that physical item only. It does not transfer or license any intellectual property rights to you.

8.2 Permitted use. Products are sold for personal use and for use in providing professional makeup services.

8.3 No copying. By placing an order, you agree that you will not, and will not help or allow anyone else to:

  • (a) copy, reproduce, replicate or imitate any product or its design, in whole or in part;
  • (b) reverse engineer, disassemble, measure, mould or analyse any product for the purpose of developing, manufacturing or sourcing an identical or substantially similar product;
  • (c) supply any product to a manufacturer, supplier or other third party as a sample or reference for that purpose;
  • (d) manufacture, sell or distribute copies or imitations of any product; or
  • (e) use our names, logos, product images or descriptions to market any other product.

8.4 Orders placed for a prohibited purpose. We may refuse or cancel any order where we reasonably believe the products are being purchased for a purpose prohibited by this section.

8.5 Remedies. A breach of this section may cause us harm that money alone cannot repair. We may seek an injunction, damages and any other remedy available under applicable law.

8.6 General. This section continues to apply after your purchase is complete. It does not restrict your normal use of the products or limit any rights you have under mandatory consumer protection law.

9. Use of this website

You agree not to misuse this website, including by interfering with its operation, attempting to gain unauthorised access, or copying its content (including text, photographs and graphics) without our written permission. If you create an account, you are responsible for keeping your login details secure and for activity under your account.

10. Liability

Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, or any rights you have as a consumer. Subject to that, we are not liable for indirect or unforeseeable losses, and our total liability for any order is limited to the amount you paid for that order.

11. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as carrier delays, customs processing, natural events or government restrictions.

12. Privacy

We handle your personal information in accordance with applicable data protection law and any privacy policy published on this website.

13. Changes to these terms

We may update these terms from time to time. The version published on this website when you place your order is the version that applies to that order.

14. Governing law

These terms are governed by the laws of the United Arab Emirates, and the competent courts of the United Arab Emirates have jurisdiction over any dispute. This does not affect any mandatory consumer rights you have under the law of the country where you live.
